Privacy Notice

This comprehensive Privacy Notice explains how we process your personal data when you use the counselhub.mx site, contact us or engage our services, in accordance with the Mexican Federal Law on the Protection of Personal Data Held by Private Parties and other applicable provisions.
1. Data controller
Lic. Daniel Nájera de los Santos, who provides legal services under the trade name CounselHub, with an address at Antiguo San Agustín 305, Colonia Antiguo San Agustín, San Pedro Garza García, Nuevo León, C.P. 66278, Mexico, is the controller of your personal data. For any privacy matter you can write to us at contacto@counselhub.mx.
2. Personal data we process
Depending on how you interact with us, we may process the following data:
- Identification and contact data: name, company, position, email address, phone number and WhatsApp.
- Data from your request: the service or plan you are interested in and the information you choose to share about your case through the form, by email or by message.
- Billing and payment data: legal name, Federal Taxpayer Registry number (RFC), tax address, tax regime and details of payments made, when you engage our services or request a tax invoice.
- Data related to the matter: the information and documents needed to provide the engaged service, which may include property or financial data, for example in collections matters, contracts or corporate transactions.
- Technical browsing data: basic technical information your browser sends when you visit the site, such as IP address, browser type and pages visited, which our hosting providers record for security and operational purposes.
We do not request sensitive personal data through the site. If processing sensitive data were necessary to handle a matter, we will ask for your express written consent. Please do not send sensitive data or third party data through the contact form.
If you provide us with data about other people, for example your employees, partners or counterparties, you represent that you have their consent or a legal basis to share it with us.
3. Purposes of processing
Primary purposes, necessary for your relationship with us:
- Responding to your contact request, scheduling calls and answering your questions.
- Preparing and sending you quotes and service proposals.
- Providing the legal services you engage and following up on your matter.
- Issuing invoices, billing statements and tax invoices, and managing payments.
- Complying with legal and tax obligations and with the anti money laundering obligations that apply to us.
- Coordinating, with your authorization, the involvement of allied attorneys in matters we do not handle in house.
Secondary purposes, which are not necessary for the relationship but help us serve you better:
- Sending you information about our services, blog articles and legal updates.
- Inviting you to events or seminars.
- Asking for your feedback on the quality of our services.
If you do not want us to process your data for the secondary purposes, write to us at contacto@counselhub.mx with the subject line "Secondary purposes". Your refusal will not be a reason for us to stop serving you.
4. Who we share your data with
We do not sell or rent your personal data. We may transfer it, without requiring your consent where the law so allows, to:
- Notaries public and commercial notaries (corredores públicos), public registries and administrative or judicial authorities, when necessary to provide the service you engaged or to defend your rights.
- Competent authorities, when a law or an order from an authority so requires.
With your prior consent, we may share the necessary data about your matter with attorneys in our network of allies, solely so they can provide the service you have authorized. They are required to treat your data confidentially.
In addition, we use providers that process data on our behalf, such as website hosting, email, cloud storage, spreadsheet and messaging services. Some of these providers have servers outside Mexico, mainly in the United States. They only process your data according to our instructions and for the purposes of this notice.
5. Your ARCO rights and withdrawal of consent
You have the right to access your personal data, rectify it if it is inaccurate or incomplete, cancel it when you consider that it is not required for any of the purposes of this notice, and object to its processing for specific purposes (known in Mexico as ARCO rights). You may also withdraw any consent you have given us, although in some cases we may not be able to fulfill your request immediately when a legal obligation requires us to continue processing your data.
To exercise these rights, send a request to contacto@counselhub.mx that includes:
- Your full name and a means for us to send you our response.
- A copy of your official identification or, where applicable, the documents evidencing the legal authority of the person acting on your behalf.
- A clear description of the data and the right you wish to exercise.
- Any document that helps locate your data and, in the case of rectification, the documents supporting the change.
We will respond by email within the time limits established by law and, if your request is granted, we will give effect to it within those same time limits.
6. How to limit the use or disclosure of your data
In addition to the procedure above, you can ask us to stop sending you information about our services by writing to contacto@counselhub.mx. We will add you to our internal list of people who do not wish to receive communications.
7. Security and confidentiality
We apply reasonable administrative, technical and physical security measures to protect your data against damage, loss, alteration, destruction or unauthorized use, access or processing. All information about your matter is also protected by the professional secrecy inherent to legal practice.
8. Data retention
We keep your data for as long as necessary to fulfill the purposes of this notice and the periods required by applicable laws, particularly tax and commercial laws. After that, we block it and securely delete it.
9. Cookies and similar technologies
This site does not use advertising or analytics cookies. We only use the technical storage necessary for it to work. You can see the details in our Cookie Policy.
10. Changes to this notice
We may modify this Privacy Notice due to changes in the law, in our services or in our practices. We will publish any change on this same page and indicate the date of the latest update.
11. Authority
If you believe your right to the protection of personal data has been violated, you may turn to the competent personal data protection authority under current legislation.
This notice may be published in other languages for reference only; in the event of any discrepancy, the Spanish version prevails.
